Prince Edward Island has stricter grease rules than any other Canadian province. Most provinces set hardware standards through the National Plumbing Code. They let cities fill the gaps. PEI goes further. Provincial rules set a required sizing formula that every commercial kitchen must use. The province also bans the small under-sink hydromechanical traps common in US kitchens. This means fewer local variations — but stricter baseline rules with no room for informal interpretations.

Restaurants, food processors, cafeterias, institutional kitchens, and dairy plants all operate under this framework. The provincial layer — mainly A Code for Plumbing Services Regulations — controls how interceptors must be sized and certified. The municipal layer, most notably Summerside's Water & Sewer Bylaw SS-01, controls what may be discharged at the point of connection. Federal rules sit above both.

Governing Authorities

PEI splits FOG oversight between the province and the two main cities. The province handles environmental laws, plumbing standards, and industrial wastewater permits. The cities administer sewer bylaws at the point of connection.

Federal Authorities

PEI follows the same federal rules as every other Canadian province. The Fisheries Act §36(3) bans putting harmful substances into fish-bearing water. The Wastewater Systems Effluent Regulations (SOR/2012-139) set baseline effluent standards for every municipal wastewater system WSER reporting guide. Operators subject to federal audit must keep all wastewater records — including grease trap maintenance logs and pumping manifests — for at least five years.

PEI's coastal geography makes the Fisheries Act especially important. The province has estuaries, salt marshes, and aquaculture zones. FOG-laden sewer overflows into tidal waters can trigger federal action against the facility and the municipality.

Provincial Authorities

Water Act (RSPEI 1988, c. W-1.1) and Environmental Protection Act (RSPEI 1988, Cap. E-9). These two laws form the backbone of PEI's environmental rules. The Water Act regulates sewage disposal and controls discharges to groundwater and surface water. The Environmental Protection Act covers plumbing and sewage system — including grease interceptors. It is the enabling authority for the provincial plumbing code regulations described below.

A Code for Plumbing Services Regulations. Enacted under the Environmental Protection Act, A Code for Plumbing Services Regulations is PEI's most important FOG-specific rule. It sets a required formula for interceptor sizing. It also explicitly says small under-sink grease traps are not adequate for commercial use. Every commercial food service business and food processing facility must comply at the design and permitting stage.

Department of Environment, Energy and Climate Action (DEECA) administers the Water Act and Environmental Protection Act. Industrial facilities that need permits to alter a wastewater discharge point, or that must report an unplanned discharge, send all applications to DEECA DEECA wastewater guidance.

Sewage Disposal Systems Regulations (under the Water Act). The Sewage Disposal Systems Regulations require anyone cleaning a grease interceptor or transporting grease waste to hold a valid provincial pumper's licence. Food service businesss must confirm their hauler is licensed before each service.

Milk Processing Regulations (Public Health Act). The Milk Processing Regulations require all milk processing plants to run dedicated waste and sewage disposal systems. Where drainage piping is used, plants must connect directly to a sanitary drain. See Industrial Pretreatment below.

Municipal Authorities

City of Charlottetown — Water and Sewer Utility. Charlottetown runs a full water and sewer utility. The City does not publish a standalone FOG-specific bylaw. Commercial food service businesss follow the provincial plumbing code and the general provincial ban on nuisance discharges. City of Summerside — Water and Sewer Bylaw SS-01. Summerside enforces strict, codified rules through Water & Sewer Bylaw SS-01 (Adopted 1999, Revised 2005). Section 15(k) sets a 50 mg/L FOG discharge limit. This is roughly half the 100 mg/L or 150 mg/L limits common in most North American cities. Compliance is purely performance-based. Installation and Sizing Requirements

PEI sets equipment standards at the provincial level. These standards are more detailed than in most other provinces. Operators planning a new commercial kitchen, a major renovation, or a new interceptor must meet two sets of rules. These are the National Plumbing Code of Canada 2020 and PEI's A Code for Plumbing Services Regulations. Both apply at the same time. This dual-compliance burden is unique to PEI.

Sizing Standards

PEI's A Code for Plumbing Services Regulations takes a firm stance on sizing. The regulation states that "the small grease traps found on some commercial/institutional kitchen drains are not considered adequate to protect the disposal system. The liquid volume must be large enough to let the water cool. This allows grease to separate and rise to the top of the grease tank." This rules out small passive under-sink traps. All commercial and institutional food service operations must use large-capacity interceptors.

The province requires a specific formula to calculate the needed grease chamber volume:

Vgrease = D × (HR/2) × GL × ST × LF

This formula is codified in A Code for Plumbing Services Regulations. The mechanical engineer or licensed plumber responsible for the design must use it. The variables account for daily wastewater flow (D), peak-hour flow fraction retained (HR/2), grease load (GL), temperature retention factor (ST), and local loading factor (LF). Any facility that uses a small under-sink unit instead of a properly calculated grease chamber will fail the provincial plumbing inspection. In Summerside, it will also fail the 50 mg/L effluent standard. This usually requires an expensive post-construction retrofit.

Installation Standards

PEI adopted the National Plumbing Code of Canada (NPC) 2020 province-wide. NPC 2020 Section 2.2.3.2.(3) directs designers and installers to CSA B481.0 for material, design, and construction requirements. It also directs them to CSA B481.3 for sizing, selection, location, and installation requirements CSA B481. Grease interceptors in PEI must carry the CSA B481 certification stamp.

This creates a dual burden. The interceptor's volume must meet the provincial Vgrease formula. The interceptor's certification must meet CSA B481 under NPC 2020. A certified but undersized interceptor fails. A correctly sized but uncertified interceptor also fails.

When a facility upgrades its system, any food service business connected to an abandoned sewage disposal system has 30 days to have it formally decommissioned. A registered septic contractor must perform the work, per provincial regulations.

Cleaning and Maintenance Frequency

PEI does not set a province-wide pumping interval. Charlottetown has no standalone FOG bylaw with a cleaning schedule. Summerside's bylaw uses a performance-based approach tied to an effluent level limit. How often you clean depends on how fast your kitchen loads the interceptor — and in Summerside, on whether the effluent stays under the legal threshold.

City-Specific Requirements

Charlottetown. The City of Charlottetown has no standalone FOG bylaw or required cleaning interval. Food service businesss follow the provincial plumbing code and the general provincial nuisance-discharge ban. There is no mandatory pumping schedule, "25% rule," or recordkeeping form specific to Charlottetown. Summerside. Section 15(k) of Water & Sewer Bylaw SS-01 bans discharging sewage with more than 50 milligrams per litre of animal or vegetable fat, oil, and grease. This is a strict limit. Most North American cities permit 100 mg/L or 150 mg/L. Meeting 50 mg/L requires good kitchen scraping habits, a properly sized interceptor, and careful maintenance.

Bylaw SS-01 does not set a fixed pumping interval. There is no mandatory 90-day pump-out, no quarterly schedule, and no "25% rule" in the bylaw text SS-01. Compliance is purely performance-based. If a municipal sample shows effluent above 50 mg/L, the facility is in violation. This applies regardless of when the interceptor was last pumped.

Section 15(d) of SS-01 also bans fats, grease, and other solid or viscous substances. These are substances capable of blocking sewers or interfering with the proper operation of pumping facilities or sewage treatment equipment. The bylaw also requires all effluent pH to stay between 5.5 and 9.5.

Note on third-party errors. Some online databases attribute specific cleaning frequencies to Summerside Bylaw SS-01. For example, some sources say "under-sink grease traps shall be cleaned at a minimum of once per week" or list a mandatory "90-day" requirement. These are incorrect. The actual SS-01 bylaw relies only on the 50 mg/L performance standard. It contains no fixed cleaning interval. Always verify against the primary bylaw text SS-01.

Best Practices for Maintenance

Summerside operators face two failure modes. The obvious one is under-pumping. An overloaded interceptor pushes FOG into the effluent stream. The less obvious one is chemical emulsification. Heavy dish soaps or degreasers can suspend FOG in the water. They push it through even a freshly pumped trap, causing effluent to exceed 50 mg/L.

Scrape and wipe pots before washing. Collect used fryer oil for a licensed renderer. Train staff not to rinse hot grease down the drain. These habits reduce interceptor loading. In Summerside, they matter as much as the pump-out schedule.

Under the A Code for Plumbing Services Regulations, the licensed pumper must record specific details after every service. These include the civic address, date of removal, exact volume removed, and the date and location of legal disposal. Get a copy at each visit. Keep records for at least five years to meet federal WSER audit requirements.

Industrial Pretreatment

PEI's dairy and agricultural processing sector produces very aggressive wastewater. Dairy effluent has extreme chemical oxygen demand (COD 2,000–4,500 mg/L). It also has naturally low pH from lactic acid. Low-pH effluent corrodes concrete sewers fast. Milk fat resists the biological treatment used at municipal plants. Dairy and food processors cannot use the restaurant kitchen sizing formula. They need dedicated industrial pretreatment.

The Milk Processing Regulations require all milk processing plants to run dedicated waste and sewage disposal systems. This means discharge balancing tanks for pH neutralization. It also means dissolved air flotation (DAF) for grease and solids removal. Biological reduction and chemical neutralization with sodium hydroxide are required before any discharge to the municipal system.

Planned and unplanned discharge events are treated differently. For a planned discharge — such as a maintenance bypass — the operator must apply to DEECA for a permit. The application must include estimates of cBOD5, Total Suspended Solids (TSS), and ammonia levels DEECA wastewater guidance.

For unplanned discharges, the trigger is 450 litres. Any unplanned discharge above 450 litres requires the operator to file a Discharge of Wastewater Notice with DEECA within one hour of detecting the event. Missing that one-hour window results in provincial penalties. This applies even if no environmental harm occurred DEECA wastewater guidance.

Federal Context

PEI's municipal FOG rules partly exist to protect the province's wastewater plants from federal prosecution. The federal government regulates fisheries and navigable waters. Environment and Climate Change Canada uses the Wastewater Systems Effluent Regulations (SOR/2012-139), made under the Fisheries Act. These rules apply to every municipal wastewater system in Canada that discharges to receiving waters WSER reporting guide.

SOR/2012-139 sets national effluent standards. Treated municipal effluent must meet carbonaceous biochemical oxygen demand (CBOD) and total suspended solids (TSS) limits before discharge. Excess commercial FOG in the sanitary sewer raises both CBOD and TSS at the treatment plant. Solidified FOG also causes sanitary sewer overflows. These events discharge raw sewage to the environment. This violates Fisheries Act §36(3). To avoid federal sanctions, each PEI municipality enforces local FOG limits. The goal is to isolate commercial loads at the kitchen before they reach the plant.

PEI's coastal geography raises the stakes. The province's estuaries and rivers support aquaculture, tourism, and Indigenous fisheries. A sewer overflow into the Hillsborough River or the North Shore estuary triggers aggressive federal enforcement. This is why Summerside's SS-01 FOG limit is 50 mg/L rather than the 100–150 mg/L common elsewhere.

Penalties and Enforcement

Summerside enforces its rules quickly. Under Bylaw SS-01 Section 4, the utility can suspend both water supply and sewer service after 48 hours of "due notice." No court process is required. A restaurant without water or sewer cannot operate.

Section 28 of SS-01 blocks a new commercial building from getting utility service. A licensed plumbing inspector must first confirm that FOG control devices are physically installed. These devices must be sized to the provincial Vgrease formula. Section 10 places absolute liability on the property owner for any downstream system damage caused by an unapproved discharge. It also requires installation of a sewerage line check valve SS-01.

Provincial penalties. Violations of the Environmental Protection Act or Water Act expose operators to admin monetary penalties from DEECA. This includes undersized interceptors, unapproved discharges, and non-compliant pretreatment. Industrial operators who miss the one-hour Discharge of Wastewater Notice deadline face additional penalties. This applies to any unplanned discharge exceeding 450 litres, even if no environmental harm occurred DEECA wastewater guidance.

Records retention. Under the Sewage Disposal Systems Regulations, only licensed pumpers may clean interceptors or transport septage. The pumper must record the civic address, date, volume removed, and disposal location right away after each service. Keep your copies for five years to meet federal WSER audit requirements.
